NON-LIABILITY WAIVER FORM

I, [Participant's Full Name], hereby acknowledge that I have voluntarily chosen to participate in Pickleball Tournament organized by SIP LLC on November 9 & 10 2024. In consideration of being permitted to participate in this activity, I agree to the following terms and conditions:

1. Assumption of Risk: I understand and acknowledge that participation in pickleball tournament involves inherent risks, including but not limited to physical injury, illness, or loss of personal property. I voluntarily assume all such risks and responsibilities associated with my participation.

2. Release of Liability: I hereby release, waive, discharge, and hold harmless SIP LLC, its employees, agents, representatives, volunteers, the venue facility and all related parties from any and all claims, demands, causes of action, or liabilities arising directly or indirectly from my participation in SI Borough President Vito Fossella 2nd annual Pickleball Cup tournament at Premiere Pickleball located at 236 Richmond Valley Road Staten Island, NY 10309, including but not limited to those arising from negligence or any other acts or omissions.

3. Indemnification: I agree to indemnify and hold harmless SIP LLC and its employees, agents, representatives, volunteers, and all related parties from all losses, damages, costs, or expenses, including reasonable attorney fees, incurred as a result of any claims or lawsuits brought against them arising from my participation in SI Borough President Vito Fossella 2nd annual Pickleball Cup.

4. Medical Authorization: I authorize my own medical insurance and its representatives to seek medical treatment on my behalf in the event of an emergency, and I agree to be responsible for any associated medical expenses.

5. Severability: If any provision of this waiver form is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

6. Governing Law: This waiver form shall be governed by and construed in accordance with the laws of New York Jurisdiction, without regard to its conflict of laws principles. By signing below, I acknowledge that I have carefully read, understood, and agreed to the terms and conditions stated in this non-liability waiver form. I understand the legal consequences of signing this document and waive any right to assert any claims against SIP LLC arising from my participation in SI Borough President Vito Fossella 2nd annual Pickleball Cup.
